Welcome to AgadirDrive. These Terms and Conditions (\"Terms\") govern the rental of vehicles between AgadirDrive (\"we,\" \"us,\" \"the Lessor\") and you (\"you,\" \"the Customer,\" \"the Lessee\"). By making a reservation or signing a rental contract with AgadirDrive, you agree to be bound by these Terms.<\/p>

If you do not agree, please do not proceed with the reservation.<\/p>

---<\/p>

1. DEFINITIONS<\/h2>

\"AgadirDrive\" refers to the car rental business operated by Youssef Dabaha, founded in 2019, registered in Agadir, Morocco.<\/p>

\"Vehicle\" means any car rented to the Customer under these Terms.<\/p>

\"Rental Agreement\" means the signed contract between AgadirDrive and the Customer at the moment of vehicle pickup, which incorporates these Terms by reference.<\/p>

\"Rental Period\" means the period from the agreed pickup date and time to the agreed return date and time. The rental period is calculated per 24 hours and cannot be split.<\/p>

\"Excess\" or \"Deductible\" means the maximum amount the Customer is responsible for in case of damage or theft, as detailed in section 7.<\/p>

2. ELIGIBILITY AND DRIVER REQUIREMENTS<\/h2>

2.1. The Customer must be at least 21 years old at the time of pickup.<\/p>

2.2. The Customer must hold a valid driving license, issued at least 2 years prior to the rental date. The license must remain valid throughout the entire Rental Period.<\/p>

2.3. The original driving license AND a valid government-issued identification (passport for non-residents, or national ID card for Moroccan residents) MUST BE PRESENTED at every rental, without exception.<\/p>

2.4. CERTIFICATES OF LOSS OR THEFT (d\u00e9claration de perte \/ vol) ARE NOT ACCEPTED in place of the original documents.<\/p>

2.5. International customers must hold a license in Latin script, OR an International Driving Permit (IDP) accompanying their original license.<\/p>

2.6. The driving license must be physically present at pickup. Photocopies, photos, or digital copies are not accepted.<\/p>

Failure to meet these requirements will result in the cancellation of the reservation without refund.<\/p>

3. RESERVATION AND CONFIRMATION<\/h2>

3.1. Reservations can be made online via our website (agadirdrive.com), by WhatsApp, by phone, or by email.<\/p>

3.2. A reservation is only confirmed when the Customer has received a confirmation message from AgadirDrive.<\/p>

3.3. AgadirDrive reserves the right to refuse any reservation at our discretion.<\/p>

3.4. The vehicle model shown on our website is for reference. We guarantee the category but reserve the right to provide a similar vehicle of equivalent or higher class.<\/p>

4. PRICING \u2014 WHAT IS INCLUDED<\/h2>

Our rental prices INCLUDE:<\/p>

4.1. Oil, maintenance, and all required vehicle documents (carte grise, insurance papers).<\/p>

4.2. Free delivery and collection at:
- Agadir Al Massira Airport (AGA)
- Hotels within the city of Agadir
- Anywhere within Greater Agadir<\/p>

4.3. Unlimited mileage anywhere in Morocco.<\/p>

4.4. Comprehensive insurance (\"all-risk\") with a non-waivable excess (see section 7).<\/p>

5. PRICING \u2014 WHAT IS NOT INCLUDED<\/h2>

The rental prices DO NOT INCLUDE:<\/p>

5.1. The non-waivable excess or deductible in case of accident, damage, or theft (see section 7).<\/p>

5.2. Fuel. The vehicle is delivered with a specific fuel level and must be returned at the SAME level. Missing fuel will be charged at market price plus a refueling service fee.<\/p>

5.3. Delivery of the vehicle to a city outside Greater Agadir. This is available on request, with a fee agreed in advance.<\/p>

5.4. Police fines, traffic violations, parking tickets, and tolls during the Rental Period.<\/p>

5.5. Scratches, dents, and interior damage (see section 6).<\/p>

6. SCRATCHES, DENTS, AND DAMAGE<\/h2>

6.1. Scratches and dents to the bodywork are considered damage and may be charged to the Customer for repair.<\/p>

6.2. Generally, ANY SCRATCH OF 2 INCHES (5 CM) OR MORE is considered damage requiring repair.<\/p>

6.3. Multiple smaller scratches or dents may also be classified as damage when their cumulative effect requires repair.<\/p>

6.4. INTERIOR DAMAGE: damage to upholstery, seats, or interior surfaces (including stains, tears, and burns) may be charged up to a maximum of 500 EUR.<\/p>

6.5. To avoid interior damage charges, we recommend:
- Transporting pets only in cages or using seat covers
- Avoiding eating or drinking inside the vehicle
- Not smoking inside the vehicle (strictly prohibited \u2014 see section 9.5)<\/p>

6.6. Vehicle condition is documented at pickup and at return. The Customer is encouraged to inspect the vehicle thoroughly during both inspections.<\/p>

7. INSURANCE<\/h2>

7.1. ALL VEHICLES are insured with a comprehensive (\"all-risk\") policy. This is a NON-WAIVABLE condition of every rental.<\/p>

7.2. STANDARD COVERAGE WITH EXCESS \u2014 1,000 EUR:<\/p>

In case of a serious accident for which the Customer is 100% responsible AND no second vehicle is involved, the Customer is responsible for an excess of UP TO 1,000 EUR.<\/p>

7.3. Damage to the vehicle is covered ONLY upon presentation of an OFFICIAL ACCIDENT REPORT (constat amiable or police proc\u00e8s-verbal). Without this document, the Customer may be held fully liable.<\/p>

7.4. If the Customer is NOT responsible for the accident, no charge will be applied (subject to insurance investigation and verification).<\/p>

7.5. If the Customer IS responsible for the accident, only damage caused to OUR vehicle will be the Customer's responsibility, up to the excess amount (1,000 EUR maximum).<\/p>

7.6. INSURANCE DOES NOT COVER damage caused by:
- Driving under the influence of alcohol or drugs
- Driving by an unauthorized person (not listed on the Rental Agreement)
- Negligence, recklessness, or willful misconduct
- Damage to tires, windshield, or undercarriage caused by misuse
- Loss or damage to personal belongings<\/p>

In these cases, the Customer is fully liable for the cost of repair or replacement, beyond the excess amount.<\/p>

8. PAYMENT, DEPOSIT AND ACCEPTED METHODS<\/h2>

\u00a0<\/p>

8.1. ACCEPTED PAYMENT METHODS:
- Cash (EUR or MAD)
- Credit Card (Visa, Mastercard)
- Check (in some cases)<\/p>

8.2. NO DEPOSIT POLICY:
AgadirDrive does NOT take a security deposit. We do not place any pre-authorization, hold, or charge on the Customer's credit card beyond the rental amount.<\/p>

8.3. INSURANCE EXCESS:
The Customer remains responsible for the insurance excess (\u20ac1,000 maximum) ONLY in case of damage caused to the vehicle during an at-fault accident, as detailed in section 7. No excess applies if there is no incident or if the Customer is not at fault.<\/p>

8.4. PAYMENT TIMING:
Payment of the rental amount is required at the start of the rental, unless otherwise agreed in writing.<\/p>

8.5. Payment of the estimated rental amount is required at the start of the rental.<\/p>

8.6. Whether a deposit is required depends on the rental duration, vehicle category, and Customer profile. AgadirDrive will inform the Customer in advance whenever possible.<\/p>

9. VEHICLE USE AND RESTRICTIONS<\/h2>

9.1. The Customer may drive the vehicle anywhere within Morocco. International border crossings (including Algeria, Mauritania, and military zones in Western Sahara) are STRICTLY PROHIBITED without written authorization.<\/p>

9.2. Off-road driving is permitted in designated 4x4 areas and unpaved tourist roads (e.g., Paradise Valley, Imouzzer, Sahara excursion routes), provided the vehicle category is suitable.<\/p>

9.3. Off-road driving in extreme conditions (deep sand, river crossings, technical 4x4 trails) requires written approval from AgadirDrive in advance.<\/p>

9.4. The vehicle MUST NOT be used for:
- Racing, rallies, or any motorsport
- Pushing, towing, or carrying another vehicle or trailer (unless approved)
- Transporting hazardous, flammable, or illegal goods
- Driving instruction or paid passenger transport (taxi, ride-share)
- Subleasing or transferring rental rights to another person
- Any illegal activity<\/p>

9.5. SMOKING inside the vehicle is STRICTLY PROHIBITED. A cleaning fee applies in case of violation.<\/p>

9.6. ADDITIONAL DRIVERS: Only persons listed in the Rental Agreement may drive the vehicle. Additional drivers may be added for a fee, subject to the same eligibility requirements (section 2).<\/p>

9.7. Pets are allowed only in transport cages. A cleaning fee may apply.<\/p>

10. RENTAL DURATION AND RETURN<\/h2>

10.1. The Customer agrees to return the vehicle to AgadirDrive on the date and time specified in the Rental Agreement.<\/p>

10.2. THE RENTAL PERIOD IS CALCULATED PER 24 HOURS AND CANNOT BE SPLIT. A rental starting at 10:00 AM ends at 10:00 AM the corresponding return day.<\/p>

10.3. A grace period of 1 hour is granted for late returns at no extra charge.<\/p>

10.4. Returns delayed by more than 1 hour will be charged an additional full day at the daily rental rate.<\/p>

10.5. The Customer must inform AgadirDrive immediately if the return will be delayed for any reason.<\/p>

11. CANCELLATION AND MODIFICATION<\/h2>

11.1. Cancellations made more than 24 hours before the scheduled pickup time are FREE OF CHARGE.<\/p>

11.2. Cancellations made less than 24 hours before pickup may incur a fee equal to one (1) day's rental.<\/p>

11.3. No-shows (failure to pick up the vehicle without prior cancellation) may be charged the full first day of rental.<\/p>

11.4. Modifications to rental dates are subject to vehicle availability and may affect the price. We will do our best to accommodate changes free of charge.<\/p>

11.5. Refunds (if applicable) are processed within 7 business days using the same payment method as the original transaction.<\/p>

12. ACCIDENTS AND THEFT \u2014 REPORTING REQUIREMENTS<\/h2>

12.1. In case of an accident, the Customer MUST IMMEDIATELY:
- Stop and secure the scene
- Contact AgadirDrive at [+212 668 15 88 60]
- Contact local authorities if there are injuries or third-party damage
- Obtain an OFFICIAL ACCIDENT REPORT (constat amiable or proc\u00e8s-verbal) \u2014 this is MANDATORY
- NOT admit fault or sign any document on behalf of AgadirDrive without consulting us first<\/p>

12.2. In case of theft of the vehicle, the Customer must:
- Report it to the police WITHIN 24 HOURS
- Provide AgadirDrive with the official police report
- Return the vehicle's keys and documents to AgadirDrive<\/p>

12.3. Failure to report an accident or theft, or failure to provide an official report, may result in the Customer being held FULLY LIABLE for damages and costs, beyond the standard excess.<\/p>

12.4. The Customer agrees to cooperate with insurance investigations and to provide any documents requested.<\/p>

13. PERSONAL BELONGINGS<\/h2>

AgadirDrive is not responsible for any personal belongings left in the vehicle, whether during or after the rental. The Customer is encouraged to inspect the vehicle thoroughly before final return.<\/p>

14. TRAFFIC FINES AND TOLLS<\/h2>

14.1. The Customer is fully responsible for any traffic fines, parking violations, tolls, or fees incurred during the Rental Period.<\/p>

14.2. AgadirDrive may charge an administrative fee for processing each fine notification received after the rental.<\/p>

14.3. The Customer authorizes AgadirDrive to share their identity and contact details with relevant authorities upon request.<\/p>

15. FORCE MAJEURE<\/h2>

Neither party shall be held liable for failure to perform any obligation under these Terms due to events beyond reasonable control, including but not limited to: natural disasters, government actions, war, pandemic, strikes, road closures, or extreme weather conditions.<\/p>

16. PRIVACY AND DATA PROTECTION<\/h2>

16.1. AgadirDrive collects and processes personal data necessary for the rental service, in accordance with our Privacy Policy (available at agadirdrive.com\/privacy).<\/p>

16.2. Personal data may be shared with insurance providers, payment processors, and Moroccan authorities when legally required.<\/p>

16.3. The Customer has the right to access, modify, or request deletion of their personal data by contacting contact@agadirdrive.com.<\/p>

17. GOVERNING LAW AND JURISDICTION<\/h2>

17.1. These Terms are governed by the laws of the Kingdom of Morocco.<\/p>

17.2. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Agadir, Morocco.<\/p>

17.3. The Customer and AgadirDrive agree to first attempt to resolve any dispute amicably through direct communication before initiating legal proceedings.<\/p>

18. AMENDMENTS<\/h2>

AgadirDrive reserves the right to update these Terms at any time. The version in effect at the time of the rental is the binding one. The latest version is always available at agadirdrive.com\/terms.<\/p>

19. FLEXIBILITY AND IN-PERSON CLARIFICATIONS<\/h2>

Our team remains available to discuss our detailed rental conditions in person at our premises in Agadir. We are flexible and willing to adapt to specific situations whenever reasonable. Do not hesitate to contact us with any question before booking.<\/p>
